Egg Donor Agreements

The major considerations with egg donation agreements are how to determine the parental roles and responsibilities, if any, of the donor; and how to protect the donor from any claim of support.

Persons who receive egg donation wish to avoid unintended claims of parental rights. Donors wish to avoid unforseen claims for support.

After conclusion of an egg donation, further steps may be necessary to conclude parentage.

The egg-donor agreement must clearly stipulate the intentions of the parties. The intended rights of the donor, if any, must be clearly defined in their contract.

If the egg donor will also be a surrogate, the importance of having an agreement which shows the intentions of the parties is all the greater. This is because, without it, the Vital Statistics Act will operate so as to presume the surrogate is the mother.
